a. Data erasure will be conducted upon a client’s request. In many cases, you will be required to provide proof of the name and address associated with the billing account before we can process your personal data or erasure request.

b. This policy does not serve as a waiver of any rights.

c. Procedure for Data Erasure:

  • i. The process begins with your request for data erasure, which must be submitted via email to support@roguewavehosting.com.
  • ii. Within 24-48 hours (subject to office hours and public holidays), Rogue Wave Hosting LLC may request proof of identification (such as a state/government-issued photographic ID or a letter addressed to the client’s registered address).
  • iii. The client will have 7 days to submit the required documents.
  • iv. Upon receipt of the documents, Rogue Wave Hosting LLC will provide next steps.
  • v. We will then provide a written response indicating acceptance of your erasure request or, if applicable, reasons for rejection along with guidance on how to resolve any issues (e.g., insufficient identification).

d. Rogue Wave Hosting LLC is not liable for any damages resulting from an erasure request being filed incorrectly or lost in transmission.

e. For individuals under the age of 13, data erasure requests must be made by a parent or legal guardian. The guardian may be required to provide transaction-based identification before the erasure request can be processed.

5. RIGHT OF APPEAL

a. If you believe we have incorrectly handled your erasure request, you may appeal our decision by following the appeal instructions provided in our final written response. To retain your right to appeal, you must do so within 28 days of receiving the response. Failure to appeal within this period will result in a waiver of your right to appeal.
